NEW STATUTES SIGNED INTO LAW:
House Bill No. 7 increasing from $5,000 to $10,000 the amount of damages that can be recovered against a parent or guardian of a minor under the age of 18 who causes property damage.
House Bill No. 112 as amended by House Amendment No. 1 relating to procedure for hospital visitations.
House Bill No. 104 relating to custody and third party visitation rights. This statute establishes procedures for visitation by non-parents and establishes procedures for those seeking such visitation.
Rule Change: This is to advise that the Supreme Court recently amended The Delaware Lawyers’ Rules of Professional Conduct Rule 1.15(a) to change the amount of a lawyer’s own money that can be kept in a Rule 1.15 trust/escrow account to cover bank fees and charges. The amount under the prior Rule was $500. Effective January 1, 2009 an attorney may now keep $1000 of his or her own money in a trust/escrow account to cover bank fees and charges.
